Vessels of Opportunity and BP Claims

As the fight to clean up the oil ensued last year, many fishermen were enrolled in the vessels of opportunity program, known to many as V.O.O. Fishermen and boat owners risked their personal safety and the their boats to clean up as much oil as they could out of the Gulf of Mexico. In June of last year moved by the tragic events that were unfolding I went out to Grand Isle and saw first hand what these fishermen were facing. Let me tell you it wasn`t pretty. You could taste the Corexit in the air as it was being scattered all over the Gulf by planes. BP was suppose to pick up the costs of having these men who were out to save our Gulf, and were ready 24/7, but they have not. Health issues have cropped up for many, boats rendered useless and BP is still trying to evade paying them much of what they are owed. Some BP Cleanup worker have Health Issues

BP Oil Spill Health Issues

Marine toxicologist, Rikki Ott, described the similarity of events surrounding the health issues of workers recruited to cleanup the oil spill in the Gulf of Mexico and their Alaskan counterparts who worked to do the same after the Exxon Valdez oil spill in 1989.

The Los Angeles Times reported that fishermen hired to cleanup BP’s mess were coming down with health issues such as nausea, severe headaches, and breathing problems after working in waters contaminated by the nation’s worst oil spill.  BP reportedly told the workers that if they encountered oil, it “wasn’t supposed to bother them”

BP did not distribute gloves, suits, or any other kind of protective gear.

Did Corexit cause Health Issues?

BP used a dipersant called Corexit, which has been tied to human health issues in the past. BP continues to use Corexit despite a deadline imposed by the EPA directing the oil company to stop using it.

Ott told the Times that the illnesses for cleanup workers were “déjà vu … What we saw with Exxon Valdez was a parallel track — sick animals and sick people. Harbor seals were looking like they were drunk and dying … and autopsies showed brain lesions….What are we exposing these poor fishermen to?”

Health Issues observed during the current BP oil spill might be most similar to those during the 1989 Exxon Valdex cleanup.

Feinberg says “No illness claims filed”

Feinberg, the attorney overseeing the payments from a $20 billion compensation fund for victims of the massive BP oil spill said Monday that he hasn’t seen any claims filed suggesting that the cleanup has caused medical illnesses.

Kenneth Feinberg is administering the Gulf Coast Claims Facility, which handles claims filed against BP PLC by individuals and businesses damaged in last year’s oil spill. Feinberg told a joint House and Senate committee reviewing the process that he hasn’t seen any scientific linkage of cleanup measures, like chemical dispersants, and health problems.

“When it comes to cleanup and the respiratory claims, I think right now the medicine and science are lacking. I haven’t seen it in the claims,” Feinberg said.

A Louisiana representative, who represents the Louisiana district hardest hit by the spill, questioned how people can be compensated if symptoms show up in later years. Feinberg responded that after 2013 the only option would be to file suit, unless another continued claims process is established.

Dispersants break up oil into smaller particles. They are generally less toxic than oil. Roughly 1.8 million gallons of the dispersant Corexit were applied in response to the Deepwater Horizon oil spill.

If health problems tied to spill remediation efforts can be proven, they might not show up for years, long after his office shuts down. He encouraged lawmakers to talk to federal officials and BP about ways to continue the claims process after his office disappears.

BP Rejects Claims by Boat Owners

BP filed a 65-page motion rejecting claims by Gulf Coast boat owners who say the oil company is liable for damages caused to their vessels by the Gulf of Mexico oil spill.

BP said that ships participating in the oil spill cleanup which are now claiming damages must first direct their claim to the Gulf Coast Claims Facility (GCCF) in accordance with mandates established by the Oil Pollution Act.

The filing states that ship owners and the state of Louisiana have filed premature claims against BP because they have not yet presented losses to the GCCF.

“BP stands ready to consider Louisiana’s OPA claims once Louisiana complies with its OPA obligations and presents them to BP,” the memo states, which was filed May 9th.

Hundreds of ship owners that participated in BP’s Vessels of Opportunity (VOO) program to help combat the oil spill filed suits claiming injuries as a result of oil spill cleanup and being in close contact with chemical dispersants.

Louisiana is suing BP for hundreds of millions of dollars in oil-spill damages. In their filing, BP stated that they have paid over $1 billion, including $580 million to state and municipal governments, through the GCCF.

BP is also facing numerous lawsuits by VOO plaintiffs who claim unpaid wages from BP.

Federal Judge Carl Barbier said he would fast-track VOO contract complaints in the multidistrict litigation surrounding the BP oil spill.
